Roughly $338 billion in crypto value received between July 2024 and June 2025. A country where a third of the adult population engages with digital assets in some form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And yet, as of 2026, using a bitcoin casino in India is not legal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s the tension at the centre of this topic, and most articles covering &#8220;bitcoin casino India&#8221; ignore it entirely. That changed with a single piece of legislation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Promotion and Regulation of Online Gaming Act, 2025 (PROGA)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong><a href=\"https:\/\/www.pib.gov.in\/PressNoteDetails.aspx?NoteId=158400&amp;ModuleId=3&amp;reg=3&amp;lang=1\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Promotion and Regulation of Online Gaming Act, 2025 (PROGA)<\/a><\/strong> was introduced on 20 August 2025, passed by Rajya Sabha on 21 August, and received presidential assent on 22 August 2025. It bans all online money games nationwide &#8211; games of skill and games of chance &#8211; overriding the patchwork of state laws that had defined the landscape for the previous 25 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a federal law. It applies across all 28 states and 8 union territories. Offshore platforms are explicitly covered &#8211; a foreign licence does not exempt an operator from PROGA&#8217;s reach when serving Indian users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The penalties are criminal in nature. Offering online money games to Indian users carries up to 3 years imprisonment and a \u20b91 crore fine. Advertising such games carries up to 2 years and \u20b950 lakh. Banks and payment processors that facilitate transactions face the same 3-year maximum as operators. All are cognisable and non-bailable offences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MeitY released draft implementation rules in October 2025. The Promotion and Regulation of Online Gaming Rules, 2026 were notified on 22 April 2026 and came into force around 1 May 2026, establishing an Online Gaming Authority of India. It predated the internet by a century and never directly addressed online play.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gambling is a <strong>State List subject<\/strong> under Entry 34 of the Seventh Schedule to the Constitution, so states had the power to legislate individually. The results were wildly inconsistent. Sikkim had licensed online casino games (roulette, blackjack, baccarat, poker via state intranet) under the Online Gaming Regulation Act, 2008. Nagaland had its own skill-game licensing framework. Tamil Nadu, Telangana, Andhra Pradesh, Assam and Odisha had all banned online gambling by 2021-2022.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The central legal concept was the skill vs chance distinction. The Supreme Court had recognised games of skill as not constituting &#8220;gambling&#8221; in landmark rulings &#8211; so rummy, poker and fantasy sports (Dream11, MPL) operated legally in most states, while Teen Patti, slots, roulette and dice were restricted across most of the country as games of chance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">PROGA eliminated this distinction entirely. The Act bans online money games regardless of skill or chance classification. State laws now operate within this federal ceiling &#8211; they cannot authorise what PROGA prohibits.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Enforcement After PROGA<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">By April 2026, MeitY had blocked or actioned over <strong>8,376 betting and gambling URLs<\/strong>, with more than 4,800 actions taken after PROGA came into force, per MediaNama. Major offshore platforms &#8211; Parimatch, 1xBet, Stake, Betway &#8211; have been explicitly named as illegal for Indian users. The Enforcement Directorate has frozen accounts and attached significant assets; DGGI attached approximately 2,000 bank accounts linked to illegal gambling transactions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Surveys suggest offshore usage actually increased after the ban. A CUTS International survey of 1,000 former real-money gaming users in Delhi-NCR (December 2025) found offshore usage rose from 68.3% pre-ban to 82% post-ban &#8211; with daily access jumping from 3.4% to 42.3%. A follow-up multi-state survey (March 2026, n=3,000) found offshore usage rising from 67.6% to 85.6%. Prohibition has historically been more effective at eliminating legal markets than actual play.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Crypto in India: Legal, But Heavily Taxed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Cryptocurrency itself is legal in India. Not legal tender, but you can buy, hold and trade it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The path to the current regime required a Supreme Court ruling. The Reserve Bank of India issued a circular in April 2018 prohibiting banks from servicing entities dealing in cryptocurrency. The Supreme Court struck this down on 4 March 2020 in <a href=\"https:\/\/indiankanoon.org\/doc\/12397485\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em>I<\/em><strong><em>nternet and Mobile Association of India v. RBI<\/em> (2020 SCC OnLine SC 275)<\/strong><\/a>, finding the RBI&#8217;s measure disproportionate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since then, crypto has operated legally &#8211; but the <strong>tax regime introduced in the Finance Act 2022<\/strong> is among the harshest in the world: a flat 30% tax on Virtual Digital Asset gains (Section 115BBH), with no loss set-off or carry-forward between assets or across tax years. Only the cost of acquisition is deductible. On top of that, 1% TDS is deducted on every crypto transfer above \u20b950,000 per Section 194S. Gains go in Schedule VDA; foreign holdings in Schedule FA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This framework has pushed significant volume to offshore exchanges, while simultaneously making India the world&#8217;s largest crypto adoption market by user count. Despite the 30% rate, Chainalysis ranked India first globally across all four sub-indices of its 2025 index.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why UPI Doesn&#8217;t Work at Bitcoin Casinos<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you&#8217;ve tried to use UPI at an offshore casino, you already know it doesn&#8217;t work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">UPI is operated by NPCI under RBI oversight. Since cryptocurrency is not recognised as currency under FEMA, receiving gambling winnings in crypto from a foreign platform is also a FEMA violation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under PROGA, any bank or payment service provider facilitating transactions to an online money gaming platform now faces criminal liability. Fiat payment rails to offshore casinos are blocked from multiple directions simultaneously.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tax on Bitcoin Casino Winnings in India<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India taxes gambling winnings at a flat rate with no exemptions and no minimum threshold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Section 115BBJ \/ 194BA (Finance Act 2023, effective 1 April 2023):<\/strong> net winnings from online gaming are taxed at 30%, with TDS deducted at source at the same rate. The \u20b910,000 threshold that previously applied under Section 194B for other gambling formats does not apply here &#8211; even \u20b91 in online gaming winnings is taxable. Winnings are reported under &#8220;Income from Other Sources.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Using Bitcoin at an offshore casino potentially creates two separate tax events at once. When you deposit BTC that has appreciated since you bought it, that disposal is a VDA CGT event &#8211; 30% tax on the gain, no loss offset. When you win at the casino, net winnings are taxable at 30% under Section 115BBJ\/194BA. A large portion of Indian crypto activity runs through peer-to-peer channels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The major FIU-IND registered exchanges are CoinDCX (16-20 million users), CoinSwitch (20-25 million), WazirX (15 million, impacted by a ~$230 million hack in July 2024), ZebPay and Bitbns. Purchases are made via IMPS, NEFT, RTGS or UPI on-ramps where banks permit it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The iGaming Market That No Longer Legally Exists<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before PROGA, India had one of the fastest-growing real-money gaming markets in the world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s online gaming market reached <strong>$3.8 billion in FY24<\/strong> (up 23% from $3.1 billion in FY23), per <a href=\"https:\/\/lumikai.com\/post\/indian-gaming-market-to-reach-9-2-bn-by-fy29\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><strong>Lumikai&#8217;s State of India Interactive Media and Gaming report<\/strong><\/a> (with Google and Deloitte, November 2024). Real-money gaming contributed approximately $2.4 billion &#8211; roughly 63% of the total. The 28% GST on full deposit value (introduced October 2023) had already squeezed the industry significantly before PROGA extinguished real-money gaming entirely. These categories now operate either without real-money stakes or through offshore platforms in direct violation of PROGA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Risks for Indian Players Using Offshore Bitcoin Casinos<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PROGA&#8217;s criminal penalties fall primarily on operators and payment facilitators, not players &#8211; but that doesn&#8217;t mean players face no risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the <strong>legal side<\/strong>, players using platforms that NPCI has flagged risk having their linked bank accounts frozen.
